Rules and Regulations
PURPOSE
USE
SUPERVISION OF CEMETERY
4. The cemetery Association reserves the right to compel all persons coming into the cemetery to obey all rules and regulations adopted by the cemetery. The rules and regulations of the Cemetery may be changed without notice to any owner by the Board of Directors and Trustees of the cemetery and the lot owner shall be bound thereby.
SALE AND PURCHASE OF INTERMENT RIGHTS
7. The sale or transfer of any interment right by any owner or purchaser shall not be binding upon the cemetery, unless same shall first be duly approved in writing by the properly authorized officer of the cemetery. This procedure is required in order that the cemetery may at all times have a complete and accurate record of all owners and purchasers. It is defined that the purchaser acquire his burial right pursuant to the rules and regulations of the cemetery.
8. The cemetery may refuse to consent to a transfer or to an assignment as long as there is any indebtedness due the cemetery from the owner so recorded in the records of the cemetery office.
9. The purchaser shall pay all sums dues and owing for interment rights in the plot purchased by the owner before the grave can be opened for burial.
10. The subdivision of interment right is not allowed without the consent of the cemetery and no one shall be buried in any lot not having an interest therein except by written consent of all parties or legally designated assignees interred in such lot and of the cemetery.
11. The right is reserved by the cemetery to insist upon at least 24 hours notice before interment and at least one week prior notice for any disinterment or removal.
12. Liners are required for all casket burials.
13. The cemetery shall in no way be liable for any delay in the interment of a body where a protest to the interment has been made or where the rules and regulations have not been complied with.
14. The cemetery shall not be liable for the interment permit nor for the identity of the person to be interred.
15. Death certificates are required for all interments within 30 days of burial.
16. No interment shall be permitted or memorial placed on any property not fully paid except by special consent of the cemetery in writing in each and every case, and in the event such consent is given any and all interments & memorials placed in or on said property shall be considered as temporary and a promissory note shall not be considered payment. Full payment must be completed within 30 days after interment.
17. Not more than one body shall be interred in one grave. In case of cremation, more than one URN or Container can be placed in grave.
18. The cemetery shall not be responsible for interment or removal or disinterment, which shall be the responsibility of owner.
19. All grave sites must be permanently marked. If any memorial or any structure whatsoever, or any inscription is placed which is determined by the cemetery to be offensive it shall be corrected or removed.
20. The cemetery reserves the right to remove any items in disrepair, including but not limited to: flowers, memorials, fencing, plants, shrubs and trees. In the case of fencing, all reasonable attempts will be made to contact the owner of the plot prior to removal.
21. No permanent fencing is allowed as of 2008, due to the difficulty of mowing and maintaining said fenced plots.
22. Fees for services provided by the cemetery shall be placed in the cemetery account. Fees will be posted at the cemetery and on the website. Current fee scheduled follows.
23. If any inconsistency exists between the rules and regulations of the cemetery and the laws of the State or Oregon, the latter prevails.
24. The cemetery is not responsible for theft or damage to anything placed on the graves or in the lots.
25. All persons are forbidden to break or injure any tree or shrub or mar any landmark, marker, or memorial or in any way deface the grounds of the cemetery.
26. These rules and regulations adopted at the regular Board of Directors and Trustees meeting, of Keno Public Cemetery Association.
